Social housing tenants must pay a supplement, named Solidarity (SLS), when their income exceeds at least 20% the resource ceilings to be respected for the allocation of social housing (see ceilings here). This amount is added to the "normal" rent and the charges.
In other words, no overlying applies provided that exceeding the resource ceiling is less than 20%.
To find out who must pay an overview, social landlords rely on the survey of resources carried out annually. In this context, the inhabitants must send them their tax of taxation (or non-taxation).In the absence of a response within one month, tenants expose themselves to a penalty of 25 euros and may be inflicted on the SLS maximum.
Reference tax income (RFR) of all the people who make up the home are taken into account, knowing that it is the reference tax income of year N-2 (income received in 2020, atLook at the tax or non-taxation notice of 2021, for a survey of resources carried out for the year 2022).
Tenants who are subject to SLS are informed by the social landlord, who must communicate the amount to them so that they can check that they do not pay more than expected.
Namely: if the tenant experienced a significant drop in his income (at least 10%) compared to year N-1 (between 2021 and 2022, for example), he must inform the lessor who will recalculate the amount of SLS.If the supporting documents are transmitted within three months of the observation of the reduction in resources, the new amount of reward will apply from the month following the event.Otherwise, it will take effect from the month following the sending of supporting documents.
Each year, HLM organizations are required by the regulations to verify the resources and the family situation of their tenants within the framework of a survey called "SLS survey", "resources survey" or "tenant survey".
This verification takes place through a pre -filled questionnaire or to be completed and to be returned by mail or email to its social landlord.
The SLS 2022 survey is intended, in the event of exceeding the resource ceiling, to determine the possible application of an overview from January 2022.The deadline for sending varies according to HLM organizations, as shown in the following examples:
Regarding an SLS due from January 1, 2022, it was advisable to reach with its form a copy of the tax notice 2021 on the 2020 income and, if necessary, the copy of a document attesting to a change of situation(family booklet in the event of birth or death, for example).
In the absence of a response within one month, the tenants expose themselves to a delay compensation of 25 euros (non -refundable penalty) and risk being inflicted the SLS maximum. If the Housing Housing Tenant does not answer the questionnaire two consecutive years, he risks expulsion (provision in force since January 1, 2018).
Some tenants subject to SLS may be forced to leave their social housing when their income significantly exceeds regulatory ceilings.Since January 1, 2018, the conditions have been hardened: a tenant who affects income at least twice and a half times higher than these limits (exceeding 150% or more against a threshold 200% or more in force until 2017) forTwo consecutive years must release the premises within 18 months or a year and a half (against a period of three years earlier). The social landlord must remind him of this deadline six months before the fateful date.
This period runs from January 1 of the year following the two years of exceeding the resource ceiling.
If the tenant sees his resources fall under the limits imposed during this period of 18 months (duration in force since January 1, 2018, against 3 years earlier), the tenant finds the benefit of maintenance in the premises and will not have to leavehousing.
Since January 1, 2018, a new case of loss of the right to maintenance in the premises applies. The tenant is concerned who does not respond to the annual resource survey for two consecutive years. However, he will again benefit from the right to keeping in the premises if, during the period of 18 months following the two years unanswered for the Resources survey, he communicates the documents and information necessary for this survey.
Namely: tenants aged over 65, disabled, with loss of autonomy or located in a sensitive urban area (ZUS) are not affected by this obligation to leave the.
The calculation of the solidarity surface is not easy.It relies on three components: the living area of the accommodation, a coefficient of exceeding the resource ceiling (CDPR) and an amount in euros/m² of living space, the supplement of reference rent (SLR), depending on the following formula::
Rooming = living space x CDPR X SLR
Namely: the amount of riding cannot represent more than 30% of the household resources (ceiling in force since January 1, 2018, against 25% previously).
The coefficient of exceeding the resource ceiling or CDPR is calculated according to a scale whose application is triggered as soon as the tenant's revenues exceed the ceilings of 20%.This scale has four exhaust slices. For each additional percentage of exceeding, apply the values of the coefficient indicated in the scale below:
Barème du coefficient de dépassement du plafond de ressources (CDPR) général | |
---|---|
Source : article R441-21 du code de la construction et de l'habitation | |
Dépassement | Valeur du coefficient |
20% | 0,27 |
21 à 59% | 0,06 |
60 à 149% | 0,08 |
A partir de 150% | 0,1 |
Example of calculating the coefficient to apply: a tenant exceeds the resource ceilings of his social housing of 25%.The applicable coefficient is equal to:
The CDPR can be modulated at the discretion of social landlords in the tense areas* where the housing supply is not enough to meet demand. The coefficient can thus be determined on the basis of a different scale, namely:
Barème du CDPR dans les zones tendues | |
---|---|
The law specifies that HLM organizations can also introduce additional coefficients between existing tranches (between 100 and 149% of overtaking for example).
*The tense areas are delimited by the decree of September 30, 2014 (to consult here)
The reference rent or SLR is fixed according to a monthly amount per square meter living space. The SLR varies depending on the location, depending on whether it is in Île-de-France or in the provinces. In 2022, he settled at:
Montant du supplément de loyer de référence par mètre carré habitable | |||
---|---|---|---|
En Île-de-France | En province | ||
Autre commune de l'agglomération parisienne, zone d'urbanisation, ville nouvelle | 2,25 euros | ||
The amount of the reference rent supplement is revised on January 1 of each year by indexing on the evolution of the rent reference index (IRL) of the third quarter of the previous year.
A Parisian tenant earns 25% higher income from applicable resources ceilings. He alone occupies an apartment of 40 square meters (living area). The surpassing coefficient to be applied is 0.57.Finally, the reference rent supplement is 2.78 euros/m² in Paris.
The solidarity rent supplement is thus established at: 40 x 0.57 x 2.78 = 63.38 euros.
In the case of a tenant who exceeds the regulatory ceilings by 150%, and must therefore leave the accommodation within 18 months, the SLS is equal to: 40 x 9.91 x 2.78 = 1.102 euros (up to 30% of household resources).
The limits from which tenants in HLM must settle an SLS in 2022 vary depending on the location and the type of social housing.
Please note: in the case of a funded accommodation using an intermediate rental loan (PLU), the tenant is not subject to the payment of an overview, whatever his income.

In accordance with an ordinance of May 15, 2019, a second cap of the SLS aims at certain tenants with a lease of private law whose accommodation has been acquired and agreed with personalized housing assistance (APL) by a social landlord and who haveconcluded a new lease in accordance with the APL Convention.
This second ceiling intends to prevent these tenants with having to pay higher rent than that of the private park. Each year, a decree of the minister responsible for housing fixes the maximum values of the cumulative amount of the derogatory rent and the SLS, per square meter of living space, taking into account the average rents (according to the annual variation of the last IRL) observed inThe different geographic areas.
For the year 2022, these values are defined as follows, in accordance with a decree of November 29, 2021 (published in the Olympic Game of December 5, 2021):
Plafonnement du montant cumulé du loyer et du supplément de loyer de solidarité | |

The government has hardened it to encourage the tenants concerned more strongly to seek another type of accommodation. The equality and citizenship law of January 27, 2017 has planned to modify several parameters of the SLS:
These measures came into force on January 1, 2018.
